These Terms & Conditions ("Terms") apply to all bookings made through breeesea.com for Breeesea retreats (each a "Retreat"). By making a booking, you ("you", "the Guest") agree to be bound by these Terms. Please read them carefully before booking.

Breeesea is referred to as "we", "us", or "our" throughout.

1. Bookings

A booking is confirmed once we have received your non-refundable deposit and you have completed the booking process at checkout. It is your responsibility to check that all details on your booking (dates, spelling of names, etc.) are correct.

2. Retreat pricing: what's included and excluded

Unless otherwise stated on the specific retreat page, the retreat price includes:

  • Accommodation for the duration of the retreat, based on twin/triple share

  • Return flights between Tongatapu and 'Eua (for the 'Eua-based retreats)

  • Guided whale swims on licensed charter boats (small group sizes)

  • All meals, filtered drinking water, tea and coffee

  • Expert water guides

  • Access to wellness facilities (e.g. ice bath, spa bath, sauna)

  • Yoga sessions

  • Marine biology presentations

  • A half-day island tour

  • A Breeesea goodie bag and souvenir merchandise (t-shirt, cap, water bottle)

  • Mask, snorkel and fin rental, upon request

  • Lead weights for belts, if required

  • Bonfire and kava ceremony

The retreat price does not include:

  • International flights to/from Tonga

  • Travel insurance (compulsory — see clause 7)

  • Gratuities

  • Alcohol and additional snacks

Exact inclusions may vary by specific retreat and will be confirmed on the relevant retreat's booking page.

3. Eligibility requirements

To join a Breeesea retreat, you must:

  • Be at least 16 years old at the time of the retreat (guests under 18 must be accompanied by a parent or legal guardian who is also booked on the retreat)

  • Be able to swim a minimum of 200 metres unassisted

  • Be in suitable physical fitness for ocean swimming and small-boat travel

You must disclose any medical condition, injury, or physical limitation that could affect your ability to safely take part before your booking is confirmed, and again before departure if anything changes. We may decline or withdraw a booking where we reasonably believe a guest cannot safely take part, in which case our standard cancellation terms (clause 5) apply.

4. Payment

  • A deposit of $1,200 AUD is required at the time of booking to secure your place. This deposit is non-refundable, but is fully transferable - for example, to another person or to a different retreat date, subject to availability.

  • The remaining balance can be paid in full, or through the payment plan available at checkout, under which the balance is split into 3 instalments, charged every 3 months following the deposit.

  • Full payment of the total trip cost must be received before the retreat departure date. If payments are not received on schedule, we may treat this as a cancellation by you under clause 5.

5. Cancellations and refunds

If you cancel

  • Your $1,200 deposit is non-refundable under all circumstances (though transferable, per clause 4).

  • If you cancel 100 days or more before the retreat start date, you will receive a refund of 50% of the total trip cost.

  • If you cancel within 100 days of the retreat start date, no refund or transfer is available on any amount paid.

We strongly recommend taking out travel insurance that covers trip cancellation, given the strict nature of this policy (see clause 7).

If we cancel

If Breeesea cancels a retreat (for example, due to insufficient numbers or circumstances outlined in clause 8), you will receive a full refund of all amounts paid.

6. Changes to your booking

Requests to change retreat dates or transfer your booking to another person are subject to availability and must be made in writing to hello@breeesea.com.au. We'll do our best to accommodate reasonable requests.

7. Travel insurance

Comprehensive travel insurance is compulsory for all guests, and must include cover for medical treatment, evacuation, trip cancellation/curtailment, and adventure/water activities. You must provide proof of valid travel insurance before departure if requested. We are not responsible for any cost, loss, or consequence arising from your failure to hold adequate travel insurance.

8. Risks, health, and safety

Breeesea retreats involve inherently physical, ocean-based activities, including boat travel and open-water swimming in proximity to marine wildlife such as whales and sharks. These activities carry real risks that cannot be entirely eliminated, including but not limited to marine wildlife behaviour, weather and sea conditions, and the physical demands of swimming and boat travel.

Wildlife sightings and encounters (including whale swims) are not guaranteed, and neither are specific weather or sea conditions. Marine wildlife is wild and its behaviour cannot be controlled or predicted, and weather, sea, or safety conditions may require guides to alter, shorten, or cancel planned activities on any given day, at the guides' discretion, for the safety of guests and crew.

No refund, discount, or compensation is provided where a retreat proceeds but wildlife sightings, whale swims, or weather/sea conditions do not meet your expectations. This is a normal and expected part of booking a wildlife- and ocean-based retreat, and is not treated as a cancellation, cancellation by us, or failure to provide the retreat under clause 5. Refunds under these Terms are only available in the circumstances set out in clause 5.

If one or more days of an otherwise-proceeding retreat cannot go ahead as planned due to weather or sea conditions (for example, a whale swim excursion is cancelled or cut short for safety reasons), no refund is provided for that day or activity. Where possible, guides will offer an alternative activity for the day, but this is not guaranteed and does not affect the price paid.

Before taking part in a retreat, you will be asked to read and sign a separate Liability and Risk Waiver, which sets out these risks in full and your acknowledgement of them. That waiver forms part of the terms on which you take part in a retreat, in addition to these Terms & Conditions.

To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded (see clause 11), Breeesea is not liable for injury, illness, loss, or damage arising from your participation in a retreat, except to the extent caused by our negligence.

9. Force majeure

We are not liable for any failure or delay in providing a retreat where this is caused by circumstances beyond our reasonable control, including extreme weather, natural disasters, pandemic or public health restrictions, government action, or failures of third-party operators (e.g. airlines, licensed charter boats, or accommodation providers). Where reasonably possible, we will work with you on rescheduling or crediting your booking in these circumstances.

10. Photography and media

We may take photos and video during a retreat for use in our marketing, social media, and website. By taking part in a retreat, you consent to appearing in this content unless you let us know in writing before the retreat that you'd prefer not to be photographed/filmed.

11. Your rights under the Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability can be limited, it is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.

12. Intellectual property

All content on breeesea.com (including text, images, and branding) is owned by or licensed to Breeesea and may not be copied or reused without our written permission.

13. Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland.

14. Complaints

If you have a complaint about your booking or retreat, please contact us at hello@breeesea.com.au and we'll do our best to resolve it promptly.

15. Changes to these Terms

We may update these Terms from time to time. The version that applied at the time you made your booking will govern that booking; the "last updated" date at the top shows the current version.
